On 18 August 2026, Sylvie Frankignoul, Patrick Van Leynseele, Fernand de Visscher and Marco Schoups led a workshop at the OBFG Universités d’Eté on “Arbitrage, médiation, tierce décision, CRA et autres MARCs : regards croisés et interactions.”

Around 70 participants were present for an interactive exploration of the different ways disputes can be resolved outside traditional court proceedings.

Patrick Van Leynseele opened with an overview of the various dispute resolution mechanisms. Judge Sylvie Frankignoul then shared her unique insights into the KMS Chamber of Amicable Settlement (KMS – CRA) of the Brussels Enterprise Court, prompting a lively discussion with the audience.

Fernand de Visscher explored binding third-party decision-making, explaining its legal basis, specific features, benefits and potential pitfalls. Patrick Van Leynseele then drew on his extensive experience to engage the audience on the ins and outs of mediation, before Marco Schoups led a discussion on arbitration: what makes it different, how well do we really know it, and what should every litigator know about it?

The workshop concluded with a practical case study. Participants were invited to develop their own dispute resolution strategy, combining different ADR techniques and, where appropriate, hybrid procedures.

The discussion confirmed that ADR is firmly part of the Belgian lawyer’s toolbox — and that, when used intelligently, it can lead to creative and effective solutions.

The strong interaction between speakers and participants made this a particularly engaging and rewarding workshop.
