Keeping with tradition, a distinguished international speaker is invited to deliver a high-level keynote address on the occasion of the Annual General Assembly.
The CEPANI Annual General Assembly is held at 4:00 pm and will be followed at 5:00 pm by the presentation from Mr. Constantine Partasides KC, Founding Partner, Three Crowns LLP. The presentation will be followed by a Q&A session and a cocktail reception starting at 6:00 pm.
This keynote will offer a meditation on why arbitrators should not fear expressing preliminary views on the merits of a dispute before their awards, and why it would benefit the arbitration process if they did. The speaker will consider the risks of challenges to arbitrators for expressing preliminary views on the merits, what our process has to learn from other fora in which it is common for judges to give indications of their direction of travel to assist the parties, and why the element of surprise that comes from an award that expresses a view that is unexpected is not a necessary ingredient of due process.
