Compensatory damages are intended to make good loss. Although this principle is widely accepted, the methods for calculating compensatory damages that ensure full reparation vary significantly depending on the jurisdiction involved. In international commercial arbitration, disputes often involved parties from different legal traditions. Arbitrators and legal counsel and quantum experts in arbitration must be mindful of the varied ways in which damages are addressed in different legal systems, especially in understanding the distinctions between civil law and common law approaches.
